Hosting Terms / Service Agreement

These Hosting Terms / Service Agreement ("Hosting Terms") govern the provision and use of web hosting and related services provided by HostYourself ("HostYourself", "we", "us" or "our"). By ordering, purchasing, renewing, accessing or using a HostYourself hosting service, you ("Customer", "you" or "your") agree to these Hosting Terms.

These are service terms. They apply to paid hosting relationships and are separate from the general Terms of Use that govern use of the public HostYourself website.

1. Agreement and Scope

These Hosting Terms apply to web hosting services, hosting accounts, website migrations, email hosting, domain-related configuration, technical support and other related services provided by HostYourself.

A particular hosting relationship may also be subject to:

  • The hosting plan selected or approved for the Customer.
  • An invoice, quotation or order confirmation.
  • Our Acceptable Use Policy.
  • Our Billing, Renewal, Cancellation & Refund Policy.
  • Our Privacy Policy.
  • Any separate written agreement entered into between HostYourself and the Customer.

If a separately signed written agreement expressly conflicts with these Hosting Terms, the signed agreement will govern to the extent of that conflict.


2. Hosting Plans

HostYourself may offer hosting plans including Micro, Standard, Large, Performance, Custom or other service configurations.

Plan features may include:

  • Website and domain allocations.
  • Storage allocations.
  • Email accounts.
  • SSL certificates.
  • WordPress compatibility.
  • DirectAdmin access.
  • Softaculous application installation.
  • LiteSpeed web-server infrastructure.
  • Backups.
  • Database access.
  • Other hosting features described in the applicable plan.

The specific resources, features and limits applicable to your service are those identified in your selected plan, order confirmation, invoice or other written service description.

Plan names do not guarantee different processor or memory allocations unless expressly stated.
Plans may differ primarily by storage, website count, email capacity, support level and other service features.

3. Account Approval

HostYourself may review a hosting request before accepting or activating service.

We may request information about:

  • The website or application to be hosted.
  • Expected website traffic or resource requirements.
  • Current hosting environment.
  • Domain and email requirements.
  • Migration requirements.
  • The intended use of the hosting account.

HostYourself reserves the right to decline a hosting request where the proposed use is inappropriate for our infrastructure, presents an unreasonable technical or security risk, violates our policies or otherwise falls outside the services we are prepared to provide.


4. Customer Account Information

You agree to provide accurate and reasonably complete information necessary to establish and maintain your hosting service.

You are responsible for keeping your contact information current, including an email address through which HostYourself can communicate with you regarding:

  • Service notices.
  • Billing and renewal.
  • Technical issues.
  • Security matters.
  • Policy or service changes.

You are responsible for maintaining the confidentiality of account credentials and for activity performed through credentials issued to you.


5. Service Activation

Hosting service generally begins after:

  • The hosting request has been approved.
  • The applicable plan and pricing have been confirmed.
  • Required payment has been received or another payment arrangement has been accepted.
  • You have accepted the applicable service terms.

Activation time may vary depending on the type of service, migration requirements, DNS changes, domain configuration and other technical factors.


6. Fees and Annual Billing

Unless otherwise agreed in writing, HostYourself hosting plans are billed annually in Canadian dollars.

The applicable price is the price confirmed at the time of purchase or renewal.

Fees may vary based on:

  • The hosting plan selected.
  • Additional services requested.
  • Custom resource requirements.
  • Website migration requirements.
  • WordPress Care or other maintenance services.
  • Applicable taxes.

HostYourself may change future pricing. Where a change affects the renewal price of an existing hosting service, we will make reasonable efforts to provide notice before the applicable renewal.

Unless a recurring billing arrangement has been separately established, hosting renewals are not automatically charged. The Customer remains responsible for paying the renewal invoice by the applicable due date.


7. Renewal

Hosting services are generally provided for the service period shown on the applicable invoice or order confirmation.

Before the end of a paid hosting period, HostYourself may send a renewal notice or invoice to the Customer's current contact email address.

To continue service, payment must be received by the applicable due date unless another arrangement has been agreed in writing.

Failure to renew may result in suspension and eventual termination of the hosting service.

Customers are responsible for maintaining a current contact email address.
Failure to receive a renewal reminder does not eliminate the Customer's responsibility to renew a hosting service that they wish to continue.

8. Taxes

Prices displayed or quoted by HostYourself may be exclusive of applicable sales taxes unless expressly stated otherwise.

Where HostYourself is required to collect applicable taxes, those amounts will be added to the applicable invoice or transaction.


9. Acceptable Use

Customers must use HostYourself hosting services in accordance with applicable law and our Acceptable Use Policy .

Prohibited uses include activities that are unlawful, abusive, fraudulent, malicious, infringing, disruptive or that present an unreasonable risk to HostYourself, its infrastructure, service providers or other customers.

HostYourself may investigate suspected violations and may suspend or terminate services where reasonably necessary to protect infrastructure, customers or third parties.


10. Resource Usage

Hosting services operate within shared technical infrastructure and are subject to reasonable resource limitations.

Customers must not use hosting services in a manner that:

  • Unreasonably degrades service for other users.
  • Consumes excessive processor, memory, database, email or other shared resources.
  • Creates persistent performance or stability problems.
  • Attempts to circumvent technical limits.
  • Uses the hosting service for an application materially beyond the intended scope of the applicable plan.

If a website outgrows its current hosting environment, HostYourself may recommend or require an upgrade, optimization, migration or movement to another hosting environment.


11. Website Content

You retain ownership of your website content, subject to any rights held by third parties.

You are responsible for ensuring that content hosted through your account:

  • Is lawful.
  • Does not infringe third-party rights.
  • Does not contain malicious software.
  • Complies with applicable licences.
  • Complies with these Hosting Terms and our Acceptable Use Policy.

HostYourself does not assume ownership of customer-hosted content solely because it is stored on our hosting infrastructure.


12. WordPress and Website Maintenance

Standard hosting services provide infrastructure for running a website but do not automatically include unlimited website administration or WordPress maintenance.

Unless expressly included in a separate service, the Customer remains responsible for matters such as:

  • WordPress core updates.
  • Plugin updates.
  • Theme updates.
  • Website content changes.
  • Application configuration.
  • Website-level troubleshooting.
  • Compatibility issues caused by third-party software.

HostYourself may offer separate WordPress Care, maintenance or technical services where requested.

Hosting keeps the website online. WordPress Care is a separate service.

13. Website Migrations

HostYourself may assist with transferring an existing website from another hosting provider.

Migration assistance is subject to:

  • Technical compatibility.
  • Availability of valid source-host credentials or backups.
  • Reasonable website size and complexity.
  • Access to required domain or DNS settings.
  • Cooperation from the existing service provider where necessary.

Although we take reasonable care when assisting with migrations, we cannot guarantee that every third-party website, plugin, application, email account or server configuration can be transferred without modification, interruption or loss of functionality.

Customers should retain an independent copy of important website data before a migration where reasonably possible.


14. Backups

HostYourself hosting services may include server-level backup infrastructure intended to support operational recovery and restoration.

Backup schedules, retention periods, storage locations and restoration capabilities may vary depending on the underlying infrastructure and service configuration.

Backups are provided as a convenience and operational safeguard and should not be treated as the Customer's only copy of important data.

Customers should maintain their own independent copies of important website content and data. HostYourself does not guarantee that every file, database, email message or historical version will always be recoverable from a server backup.

15. Email Services

Where email hosting is included, the Customer is responsible for appropriate use of email accounts associated with the hosting service.

Customers must not use HostYourself email services for:

  • Unsolicited bulk email.
  • Spam.
  • Fraudulent or deceptive messages.
  • Phishing.
  • Malware distribution.
  • Activity likely to damage email-server reputation or deliverability.

Email delivery depends on many external systems and cannot be guaranteed in every circumstance.


16. Domains and DNS

HostYourself may assist with domain names, DNS records, nameservers or related configuration.

Unless a separate written transaction states otherwise, ownership of a Customer's domain remains with the Customer or the registered domain holder.

The Customer is responsible for maintaining domain registration where HostYourself is not expressly responsible for the registration or renewal.

DNS changes may require time to propagate across third-party networks and are not entirely within HostYourself's control.


17. Security

HostYourself uses reasonable technical and administrative practices intended to support the security of hosting infrastructure.

Customers are also responsible for reasonable security practices, including:

  • Using strong and unique passwords.
  • Protecting login credentials.
  • Keeping applications reasonably current.
  • Removing abandoned or unnecessary software.
  • Restricting administrative access appropriately.
  • Promptly reporting suspected account compromise.

No hosting system connected to the Internet can be guaranteed completely secure.


18. Technical Support

Hosting-level support generally covers issues relating to the hosting environment provided by HostYourself.

This may include reasonable assistance with:

  • Hosting account access.
  • DirectAdmin-related hosting functions.
  • DNS configuration.
  • SSL configuration.
  • Email configuration.
  • Hosting-level availability or server issues.

Unless separately agreed, hosting support does not include unlimited:

  • Website development.
  • Custom programming.
  • WordPress administration.
  • Plugin troubleshooting.
  • Theme modification.
  • Content editing.
  • Third-party application support.

19. Service Availability

HostYourself seeks to provide reliable hosting services, but no Internet-connected hosting environment can be guaranteed to operate without interruption.

Service may be affected by circumstances including:

  • Planned maintenance.
  • Emergency maintenance.
  • Hardware or software failure.
  • Network or upstream-provider outages.
  • DNS failures.
  • Cybersecurity incidents.
  • Distributed denial-of-service attacks.
  • Third-party service failures.
  • Events outside HostYourself's reasonable control.

Unless expressly stated in a separate written Service Level Agreement, HostYourself does not guarantee a specific percentage of uptime or service availability.


20. Maintenance

HostYourself or its infrastructure providers may perform planned or emergency maintenance where reasonably necessary to maintain security, stability or service operation.

Where practical, we may provide notice of material planned maintenance that is expected to significantly affect customer services.

Emergency maintenance may be performed without advance notice where reasonably necessary.


21. Suspension of Service

HostYourself may suspend some or all hosting services where reasonably necessary because of:

  • Non-payment.
  • A material violation of these Hosting Terms.
  • A violation of the Acceptable Use Policy.
  • A security compromise or suspected compromise.
  • Malware, phishing or abusive activity.
  • Excessive resource consumption affecting service stability.
  • A legal requirement or lawful request.
  • A serious risk to infrastructure, customers or third parties.

Where appropriate and reasonably practical, HostYourself will attempt to contact the Customer before or promptly after suspension.

In urgent security, abuse or infrastructure-protection situations, immediate suspension may be necessary.


22. Cancellation by the Customer

Customers may request cancellation of hosting services by contacting info@hostyourself.com .

Cancellation prevents future renewal but does not necessarily entitle the Customer to a refund for an already-paid service period.

23. Termination by HostYourself

HostYourself may terminate a hosting service where:

  • The Customer materially breaches these Hosting Terms.
  • The Customer fails to pay required fees.
  • The service is used for unlawful or prohibited activity.
  • The Customer repeatedly creates security, abuse or infrastructure problems.
  • Continued provision of the service is no longer reasonably practical.

Where circumstances permit, HostYourself will make reasonable efforts to provide notice and an opportunity to address a remediable issue before termination.

Serious unlawful, malicious or security-threatening activity may result in immediate termination.


24. Data Following Cancellation or Termination

Following cancellation, expiration or termination, HostYourself is not required to preserve hosted data indefinitely.

Customers are responsible for obtaining copies of website files, databases, email and other information they wish to retain before service ends.

HostYourself may delete account data after a reasonable period following termination or expiration, subject to operational backup retention and applicable legal requirements.

Do not rely on an expired hosting account as data storage.
Customers should export or otherwise preserve any information they require before the service terminates.

25. Customer Responsibility for Third-Party Software

Websites may rely on third-party software such as WordPress, themes, plugins, APIs, libraries, email services or external platforms.

HostYourself does not control these third parties and cannot guarantee their:

  • Availability.
  • Compatibility.
  • Security.
  • Functionality.
  • Pricing.
  • Continued development.

A hosting-service problem does not necessarily include defects or outages caused solely by third-party applications or services.


26. Privacy

HostYourself handles personal information in accordance with our Privacy Policy .

Hosting and support activities may require access to limited customer, account or technical information where reasonably necessary to provide, secure, troubleshoot or administer the service.


27. Service Providers

HostYourself may use third-party infrastructure, software and service providers in order to deliver hosting services.

These may include providers of:

  • Server infrastructure.
  • Data-centre services.
  • Hosting control panels.
  • Backup systems.
  • Email filtering.
  • Software licensing.
  • Security services.
  • DNS and network services.

Use of third-party infrastructure does not transfer ownership of the Customer's website content to those providers.


28. Disclaimer

To the fullest extent permitted by applicable law, HostYourself services are provided on an "as available" basis subject to the service description and any written commitments expressly applicable to the Customer's plan.

HostYourself does not warrant that hosting services will operate without interruption, that every third-party application will remain compatible, or that all data can always be recovered following a failure or security incident.

Nothing in these Hosting Terms limits statutory rights or obligations that cannot lawfully be excluded.


29. Limitation of Liability

To the fullest extent permitted by applicable law, HostYourself will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or relating to the hosting service.

This may include loss of:

  • Profit.
  • Revenue.
  • Business opportunity.
  • Goodwill.
  • Data.
  • Use of a website or service.

To the fullest extent permitted by applicable law, HostYourself's aggregate liability arising from a particular paid hosting service will not exceed the fees actually paid to HostYourself for that hosting service during the twelve months immediately preceding the event giving rise to the claim.

Nothing in this section excludes liability that cannot lawfully be limited or excluded.


30. Indemnification

To the extent permitted by applicable law, the Customer agrees to indemnify and hold harmless HostYourself and its operators, employees, contractors and service providers from third-party claims, liabilities, losses and reasonable costs arising directly from:

  • Unlawful content hosted through the Customer's account.
  • Infringement caused by Customer-provided content.
  • Misuse of the hosting service.
  • A material violation of these Hosting Terms or the Acceptable Use Policy.
  • Malicious or intentionally harmful activity performed through the Customer's account.

31. Force Majeure

HostYourself will not be responsible for delays or failures caused by events reasonably beyond our control.

These may include severe network failures, natural disasters, utility failures, widespread Internet outages, acts of government, labour disruptions, cyberattacks, data-centre incidents or failures of critical upstream providers.


32. Changes to Services

HostYourself may reasonably modify hosting technologies, infrastructure, software, service providers or technical configurations as services evolve.

We will make reasonable efforts to avoid materially reducing the core service purchased by an existing Customer during a paid service period.

Changes may be necessary for security, compatibility, availability, performance, legal or operational reasons.


33. Changes to These Hosting Terms

HostYourself may update these Hosting Terms from time to time to reflect changes in our services, infrastructure, business practices or applicable requirements.

The Effective Date at the top of this page identifies the most recent version.

Material changes affecting an active paid service may be communicated by email, website notice or another reasonable method.


34. Governing Law

These Hosting Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to rights or jurisdictions that cannot lawfully be excluded, disputes relating to these Hosting Terms or HostYourself hosting services will be submitted to courts of competent jurisdiction in Ontario, Canada.


35. Severability

If any provision of these Hosting Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where permitted, and the remaining provisions will continue in effect.


36. Entire Agreement

These Hosting Terms, together with the applicable hosting plan, invoice, order confirmation, Acceptable Use Policy, Billing Policy and any other applicable written agreement, constitute the agreement governing the hosting service.
